1. Acceptance of Terms

By downloading, installing, or using the Race360 application ("App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

2. Age Restrictions

You must be at least 16 years old (or the minimum age required in your jurisdiction) to use this App. By using the App, you represent and warrant that you meet this requirement.

3. Description of Service

Race360 is a mobile application designed for driving enthusiasts to track, analyze, and share their driving experiences. The App allows users to record drives, create custom race strips, compete with friends, and analyze driving performance.

4. User Responsibilities

Users of Race360 agree to:

• Use the App in accordance with all applicable laws and regulations
• Not engage in dangerous or illegal driving behaviors while using the App
• Not manipulate data or use external devices to artificially enhance performance metrics
• Take full responsibility for their driving behavior and safety
• Respect the privacy and rights of other users

5. Account Registration

To use certain features of the App, you may be required to register for an account. You agree to provide accurate information and keep your account credentials secure. You are solely responsible for any activity that occurs under your account.

6. Safety Disclaimer

Race360 encourages safe driving at all times. The App is designed for use on private roads, race tracks, or in environments where spirited driving is legal and safe. Never use your phone while driving or violate traffic laws. Race360 and its creators are not responsible for any accidents, injuries, or legal consequences resulting from the use of the App.

7. User Content

Users may create content within the App, including but not limited to drive recordings, custom race strips, and social posts. By creating such content, you grant Race360 a non-exclusive, worldwide, royalty-free license to use, modify, publicly display, and distribute such content for the purpose of providing and improving the App.

8. Intellectual Property

All intellectual property rights related to the App, including but not limited to software, design, logos, and content created by Race360, are owned by Race360 or its licensors. You may not copy, modify, distribute, or create derivative works based on the App without explicit permission.

9. Limitation of Liability

To the maximum extent permitted by law, Race360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. Race360 does not warrant that the App will be uninterrupted, error-free, or completely secure.

11. Indemnification

You agree to indemnify and hold harmless Race360 and its affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of New Zealand.

13. Modifications to Terms

Race360 reserves the right to modify these Terms and Conditions at any time. We will notify users of significant changes through the App or via email. Your continued use of the App after such modifications constitutes your acceptance of the updated terms.

14. Termination

Race360 may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms and Conditions.
